Terms of Service

By accessing and using FaceIQ Labs ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you may not create an account or use the Service in any way.

By accessing "Your Plan" and "Your Potential" features, you acknowledge and agree that:

• You understand this information is for educational and informational purposes only
• You will consult with qualified medical professionals before considering any cosmetic or surgical procedures
• You understand that all surgical procedures carry inherent risks including but not limited to complications, dissatisfaction with results, and health risks
• You take full responsibility for any decisions you make based on this information
• You will verify the accuracy of your landmark placements before relying on any analysis
• FaceIQ Labs assumes no liability for any outcomes resulting from your use of this information or any procedures you may choose to undergo

By using the Service, you acknowledge and agree that:

• We store your account information, including your email address, username, and profile data
• We store all photos (front and side facial images) that you upload to the Service for the purpose of providing facial analysis and maintaining your analysis history
• We store your analysis results, facial measurements, scores, and progress tracking data
• We may store content you submit to the Loop or other community features, including posts, comments, profile content, direct messages, images, videos, links, and attachments
• You retain ownership of the content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, format, adapt, display, and distribute that content as needed to operate, provide, secure, moderate, and improve the Service
• You are responsible for ensuring you have the necessary rights to upload, share, publish, and process any content, including consent from any individuals pictured or otherwise identifiable
• You must only upload images of yourself or individuals who have given explicit permission, and you must not share content that infringes privacy, publicity, copyright, trademark, or other rights
• Content you make public in the Loop may be visible to other users and may be reshared within Service features; direct messages are intended only for participants in the relevant conversation, subject to our rights to review, preserve, or disclose content as required by law or reasonably necessary to enforce these Terms, investigate abuse, or protect users and the Service
• We may review, moderate, restrict, remove, or refuse any user-generated content, and may suspend related accounts, at any time if we believe content violates these Terms, creates risk, or could harm FaceIQ Labs or its users

Data Deletion: You may request deletion of your account and all associated data at any time by contacting us at support@faceiqlabs.com. Upon receiving a valid deletion request, we will delete your account, uploaded images, analysis results, and personal data within 30 days, except where retention is required by law or necessary to resolve disputes, enforce our agreements, or comply with legal obligations. If you are located in the European Economic Area, United Kingdom, or California, you may have additional rights under GDPR or CCPA, including the right to access, correct, or port your personal data. Please refer to our Privacy Policy for full details on your data rights.

Billing Intervals: Subscriptions are available on monthly, quarterly, and yearly billing cycles. By subscribing, you authorize us to charge your payment method at the start of each billing period. Monthly subscriptions are billed every month. Quarterly subscriptions are billed every three months as a single upfront payment. Yearly subscriptions are billed once per year as a single upfront payment for the full year. Quarterly and yearly plans may offer a discount compared to the equivalent monthly rate.

Yearly Subscriptions: By purchasing a yearly subscription, you acknowledge and agree that you are committing to a full year of service and that the entire annual amount will be charged upfront at the time of purchase. Yearly subscriptions auto-renew at the end of each annual period unless cancelled before the renewal date.

Refund Policy: We offer a 14-day refund period for new monthly subscriptions, provided that you have not used the Service. "Use of the Service" is defined as generating at least one facial analysis. If you have not generated any analyses within 14 days of your purchase, you are eligible for a full refund. After 14 days, or once you have generated your first analysis, all payments are final and non-refundable. For quarterly and yearly subscriptions, the same 14-day refund policy applies from the date of purchase, subject to the same usage conditions. No partial or prorated refunds are available for unused portions of quarterly or yearly billing periods.

Exceptions: Refunds may be issued at our discretion in cases of payment processing errors (e.g., duplicate charges, overcharges) or if you are unable to access the Service due to a fault on our end. We do not offer refunds for dissatisfaction with analysis results or for technical issues such as bugs or glitches, though we encourage you to report them so we can improve the Service.

Reporting Issues: If you encounter bugs, glitches, or technical problems with the Service functionality, please report them on our Discord server so we can investigate and fix them. Application bugs do not qualify for refunds.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service until the end of your current billing period (month, quarter, or year). Your subscription will not renew after the current period ends. For yearly subscriptions, this means you retain access until the end of the full year you paid for, but no refund is issued for the remaining time.

Subscription Tiers and Access: Different subscription tiers provide different levels of access and features. If you downgrade or cancel your subscription, you will immediately lose access to all features and data exclusive to higher tiers, including previously unlocked analysis results and measurements. This data is not deleted and will become accessible again if you upgrade or renew your subscription to the appropriate tier. We do not provide prorated refunds or credits when downgrading.

Our Right to Terminate: We reserve the right to suspend, terminate, or cancel your subscription and account at any time, for any reason, without prior notice or explanation, and without refund. This includes, but is not limited to, violations of these Terms, suspected misuse of the Service, uploading inappropriate content, attempts to resell or redistribute analysis results, or use of the Service to harm others.

Price Changes: We reserve the right to modify our pricing at any time. Any price changes will apply to subsequent billing periods and you will be notified in advance.

Availability: Free trials are NOT generally available to all users. Free trials are exclusively available as a reward for partners who successfully refer a paying customer. If you are on the free plan and participate in our Partner Program, you may receive a free trial when your first referral makes their first payment. There is no other way to obtain a free trial — users cannot sign up for a free trial directly.

Trial Terms: When you earn a free trial through the Partner Program, you receive a trial period (typically 3 days) with access to analysis features. The exact trial duration and feature access may vary and are determined at our discretion. To claim your trial reward, you must select a subscription plan and provide valid payment information.

Trial Limitations: Free trial access is limited in scope compared to paid subscriptions. Trial users receive a access to certain features compared to full paid plans. Trial access does not carry over after the trial period ends.

Automatic Conversion: At the end of the free trial period, your subscription will automatically convert to a paid subscription at the then-current rate unless you cancel before the trial ends. You authorize us to charge your payment method on file when the trial period concludes.

One Trial Per User: Each user is entitled to only one free trial. Creating multiple accounts to obtain additional free trials is a violation of these Terms and may result in immediate account termination without refund.

FaceIQ Labs offers a Partner Program that allows users to earn commissions by referring new customers to the Service. By participating in the Partner Program, you agree to the following terms:

Eligibility: Any registered user may apply to become a partner. We reserve the right to accept or reject any partnership application, or to terminate any partnership at any time, for any reason, without notice or explanation.

Referral Links: Partners receive unique referral links and may create multiple tracking links for different campaigns (up to 20 links). Partners may also generate a personalized discount coupon code (typically 20% off) to share with potential referrals. Referral links and coupon codes must be associated with your account and may not be transferred, sold, or shared with other partners.

Commission Structure: Partners earn a percentage of each payment made by users they refer. The commission rate starts at 15% and increases based on the total revenue generated by your referrals, up to a maximum of 30% at the highest tier. Commission rates and tier thresholds are:

• Starter (15%): $0+ total referral payments
• Bronze (17%): $100+ total referral payments
• Silver (18%): $250+ total referral payments
• Gold (20%): $500+ total referral payments
• Platinum (22%): $1,000+ total referral payments
• Diamond (25%): $2,500+ total referral payments
• Elite (27%): $5,000+ total referral payments
• Champion (30%): $10,000+ total referral payments

We reserve the right to modify commission rates, tier thresholds, or the entire commission structure at any time. Changes will apply to future earnings only.

Recurring Commissions: Commissions are recurring, meaning you earn commission on every payment made by your referrals for as long as they remain subscribed, not just their first payment.

Attribution: A referral is attributed to you when a user signs up using your referral link or coupon code. The referral relationship is permanent unless the referred user requests removal or their account is terminated.

Partner Rewards: In addition to commissions, partners may receive a one-time reward when their first referral makes a successful payment. The reward depends on your current subscription status at the time the referral pays:

• Free plan partners: Receive a 3-day free trial with full analysis access when your first referral makes their first payment. This allows you to try the Service before committing to a paid subscription.
• Basic plan partners ($24.99/month): Receive a credit equivalent to one month free ($24.99) applied toward your next billing cycle when your first referral makes their first payment.
• Pro plan partners ($49.99/month): Receive a credit equivalent to one month free ($49.99) applied toward your next billing cycle when your first referral makes their first payment.

Reward eligibility is based on referrals who have made at least one successful payment — signups alone do not qualify for rewards. Rewards are one-time only; subsequent referrals earn commissions but not additional free months or trials.

Payouts: Commission earnings accumulate in your partner account balance. You may request a payout once your available balance reaches the minimum threshold (currently $10). Payouts are processed exclusively through Stripe Connect. To receive payouts, you must:

• Create and connect a valid Stripe account through our platform
• Complete Stripe's identity verification and onboarding requirements
• Provide accurate banking information for fund transfers
• Comply with Stripe's Connected Account Agreement and all applicable Stripe terms and policies

By connecting a Stripe account to receive payouts, you agree to be bound by Stripe's terms of service in addition to these Terms. FaceIQ Labs is not responsible for any issues arising from your Stripe account, including but not limited to account holds, verification failures, or payout delays imposed by Stripe. Payout requests are reviewed and processed at our discretion, and we reserve the right to delay or withhold payouts if we suspect fraud or violations of these Terms.

Prohibited Practices: Partners must not engage in any deceptive, misleading, or unethical practices when promoting the Service. This includes but is not limited to:

• Making false claims about the Service, its features, or results
• Spam, unsolicited bulk messaging, or other intrusive marketing
• Bidding on our brand terms in paid advertising
• Misrepresenting your relationship with FaceIQ Labs (e.g., claiming to be an employee or official representative)
• Self-referrals using multiple accounts
• Cookie stuffing, click fraud, or other technical manipulation
• Referring users who you know intend to request refunds or chargebacks
• Any activity that violates applicable laws or regulations

Commission Clawbacks: If a referred user requests and receives a refund, files a chargeback, or their payment is otherwise reversed, the commission associated with that payment will be deducted from your available balance. If your balance is insufficient, the amount owed may be deducted from future earnings.

Termination: We may suspend or terminate your partnership at any time, for any reason, without notice. Reasons for termination may include violation of these terms, suspected fraud, abuse of the program, or any conduct we deem harmful to FaceIQ Labs or its users. Upon termination for cause (fraud, abuse, or violation of these Terms), your accumulated balance may be forfeited. Upon termination without cause, any undisputed earned balance above the minimum payout threshold will be paid out within 60 days, provided you have a valid payout method on file.

Tax Responsibility: Partners are solely responsible for reporting and paying any taxes owed on their commission earnings. FaceIQ Labs does not withhold taxes and may issue tax forms as required by law.

FaceIQ Labs periodically runs contests related to our Celebrity Face Database where users can earn cash prizes and rewards by contributing quality celebrity face mappings. By participating in any contest, you agree to the following terms:

Eligibility: Contests are open to all registered users who have a valid account in good standing. Users must be at least 18 years old or the age of majority in their jurisdiction to receive cash prizes. One account per person; creating multiple accounts to increase chances of winning is strictly prohibited and will result in disqualification.

Submission Requirements: To be counted toward contest standings, submissions must:

• Be complete with both front and side profile landmarks properly mapped
• Be approved by our review team (pending submissions do not count)
• Accurately represent the named celebrity
• Use clear, high-quality reference images
• Be submitted during the active contest period

Approval Process: All submissions are reviewed by our team to ensure quality and accuracy. We reserve the sole right to approve or reject any submission. Our decisions regarding submission approval are final and not subject to appeal. A celebrity is considered "completed" after receiving 3 approved submissions, after which no additional submissions for that celebrity will be accepted or counted.

Winner Determination: For the Leaderboard Contest, winners are determined by the total number of approved submissions at the contest end time. In case of a tie, the user who reached that number first (based on submission timestamps) will be ranked higher. For the Celebrity Hunt, the first approved submission (based on submission timestamp) wins. All decisions regarding winners are made at our sole discretion and are final.

Contest Period: Contest start and end dates are announced on our platform and official communication channels. Submissions made outside the contest period will not be counted toward contest standings, though they may still contribute to the Celebrity Face Database.

Prize Payouts: Cash prizes will be paid out within 30 days of contest conclusion and winner verification. We offer flexible payout methods to accommodate winners worldwide, including but not limited to:

• PayPal
• Bank transfer (wire transfer)
• Stripe payouts
• Cryptocurrency (Bitcoin, Ethereum, USDC)
• Other methods mutually agreed upon by the winner and FaceIQ Labs

Winners will be contacted via their registered email address to arrange payout. Winners must respond within 14 days and provide necessary payment information. Failure to respond or provide valid payment details within 30 days may result in forfeiture of the prize.

Subscription Rewards: Subscription prizes will be applied to the winner's account within 7 days of contest conclusion. If the winner already has an active subscription, the reward period will be added to their existing subscription. Subscription rewards have no cash value and cannot be transferred or exchanged.

Tax Responsibility: Winners are solely responsible for reporting and paying any applicable taxes on their prizes. FaceIQ Labs may require winners to provide tax identification information (such as a W-9 for US residents) before prizes can be paid. We may issue tax forms as required by law.

Disqualification: We reserve the right to disqualify any participant at any time, for any reason, including but not limited to:

• Creating multiple accounts to game the contest
• Submitting fraudulent, misleading, or low-quality mappings
• Using automated tools or bots to submit mappings
• Colluding with other participants to manipulate results
• Violating any other terms of these Terms of Service
• Any conduct deemed unfair or contrary to the spirit of the contest

Contest Modifications: We reserve the right to modify, suspend, or terminate any contest at any time, for any reason, with or without notice. This includes changing prize amounts, eligibility requirements, contest duration, or any other aspect of the contest. In the event of early termination, we will make reasonable efforts to award prizes based on standings at the time of termination, but we are not obligated to do so.

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload images of individuals without their explicit consent
• Upload images of minors (individuals under 18 years old)
• Use the Service to harass, bully, or harm others
• Share or distribute analysis results of others without their permission
• Upload content that is offensive, harmful, or violates any rights of others
• Post, message, or otherwise share content in the Loop that is defamatory, obscene, sexually exploitative, violent, threatening, hateful, harassing, deceptive, or otherwise unlawful
• Share another person's private, confidential, or personal information without authorization
• Impersonate any person or entity, misrepresent your identity, credentials, or affiliation, or manipulate engagement through fake accounts, spam, scams, or coordinated inauthentic activity
• Attempt to circumvent any security features, access restrictions, or usage quotas
• Use automated means to access the Service without permission
• Interfere with or disrupt the Service or servers
• Upload malware, malicious code, or content intended to phish, exploit, or compromise others
• Misrepresent our analysis results as professional medical or aesthetic opinions

The Service, including all software, algorithms, designs, and content provided by FaceIQ Labs (excluding user-generated content), is owned by FaceIQ Labs and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

As between you and FaceIQ Labs, you retain ownership of content you submit to the Service. However, by submitting content to public areas of the Service, including the Loop, you authorize us to make that content available to other users according to the functionality of the Service.

Entertainment and Informational Purposes Only: The Service is provided strictly for entertainment and informational purposes. All facial analysis results, scores, ratings, measurements, insights, treatment options, and projected potential scores (including those in "Your Plan" and "Your Potential" features) are generated by algorithms and do NOT constitute:

• Medical, health, or professional advice
• Medical information, diagnosis, or treatment information
• Recommendations for cosmetic procedures or treatments
• Advice or suggestions that you should undergo any procedure
• Objective assessments of beauty or attractiveness
• Professional opinions from licensed practitioners
• Factual statements about your appearance or worth
• Guarantees of any results if you follow any treatment options

No Medical Use: DO NOT use the Service to make decisions about medical procedures, cosmetic surgery, or health treatments. The surgical and procedural information in "Your Plan" and "Your Potential" features is for educational purposes only. Always consult qualified medical professionals for any health or appearance-related decisions. No information provided by this Service should be used as a basis for medical decisions.

Landmark Accuracy Dependency: All analysis results, including "Your Plan" treatment options and "Your Potential" scores, are calculated based on facial landmarks placed by the user. The accuracy of our analysis is entirely dependent on the accuracy of your landmark placement. Inaccurate landmarks will produce inaccurate results. You are solely responsible for ensuring landmarks are placed correctly. All potential scores are estimates and may not reflect actual results.

Subjective Nature: Beauty and attractiveness are subjective. Our analysis is based on mathematical calculations and should not be interpreted as truth or used to judge yourself or others.

Accuracy: While we strive for accuracy in our algorithms, facial analysis results may contain errors, inaccuracies, or variations. We make no guarantees about the precision or reliability of any measurements, scores, treatment options, or projected potential outcomes.

Service Availability: We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" without warranties of any kind.

User-Generated Content: The Loop and other community features may contain content provided by users. We do not endorse, guarantee, or assume responsibility for the accuracy, legality, safety, quality, or reliability of user-generated content, and your interactions with other users are at your own risk.

Limitation of Liability: To the maximum extent permitted by law, FaceIQ Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: any emotional distress; decisions made based on analysis results, treatment options, or projected scores; actions taken in reliance on the Service; any cosmetic or medical procedures you may undergo; any user-generated content, messages, posts, comments, media, or interactions with other users; or any outcomes resulting from following or considering any information or treatment options provided by the Service.

Aggregate Liability Cap: In no event shall FaceIQ Labs' total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of (a) the total amount you have paid to FaceIQ Labs in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Indemnification: You agree to indemnify, defend, and hold harmless FaceIQ Labs, its operators, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any images or other content you upload, publish, send, or otherwise make available through the Service; or (e) any decisions or actions you take based on analysis results, treatment options, or information provided by the Service.

Any dispute arising out of or in connection with these Terms of Service, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The seat of the arbitration shall be Wilmington, Delaware. The language of the arbitration shall be English.

Small Claims Court Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction, provided the claim is brought and maintained on an individual basis.

Class Action Waiver: You and FaceIQ Labs agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against FaceIQ Labs. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.
